PRIVACY POLICY

 

Following Regulation EU2016/679 about the processing of personal data, with particular reference to art. 13, with this document Malvi & Co. Srl with its headquarters in Belluno (BL), via Cavessago, 44 (BL) 32100 provides the following information to Clients:

 

i) Controller of the collection and the processing of personal data is the Company Malvi & Co. Srl (below called Company) with its legal address in Milano (MI), via Larga, 7, enrolled to the Registro delle imprese (Business register) of Milan (MI), social security number 05199130963, VAT number n. 05199130963, to which the Client can send to its headquarters a specific request addressed to Malvi & Co. Srl via Cavessago, 44 32100 Belluno (BL), or, by e-mail, to the following address info@malvi.net.

 

ii) The Company informs that the processing of the Client’s personal data will be done following the aims below:

 

[a] to consent to the Client the access to the Company’s website dedicated to online sales of its products and consequently to consent to the Client to realise all the buying procedures, besides to give the Company the opportunity to fulfill all the accounting, commercial and fiscal requirements due to online sales, or more in general, to follow the law requirements. (1);

 

[b] to declare to the Client, through the sending of advertising and informative material by periodic e-mails and news about products and services of the Company and possible further initiatives, commercial or not.

 

iii) the Company will process the data following the Privacy Policy without disclosing them to not authorised people, nor to use them for different purposes from the ones declared and not to collect or to transmit them to third parties that are not included in the following. Personal data can be communicated only to the delegated subjects, who must realize contract duties, hired by the Provider and the Client (e.g. banks, door-to-door couriers, freight forwarders, accounting firms or other companies that collaborate with Malvi & Co. for the technical and informatics management of the website). Couriers and freight forwarders can know personal data of the Clients, the people in charge of following the website, the people in charge of marketing activities and the personnel dedicated to the fulfillment of law requirements.

 

iv) The Company informs that it does not proceed with neither profiling of its Clients, nor taking automated individual decision-making processes focused on this goal.

 

v) The acquired data will be preserved for a period of time not greater than the one necessary for the reasons why they were collected and later used in respect of law terms. In particular, when the data are related to a specific account created by the Client at the moment of joining the website, we want to inform you that the Company will proceed to erase the data automatically if the Client will not place any online orders in the following 36 months after the last buying. In case of data used with marketing aims (see previous lett. [b]) the processing will be done nevertheless the Client will use the power of suspension, see lett. vi), with the consequent erasure of the data from the mailing list in which they are inserted.

 

vi) Each data subject has the rights of artt.15 and following of the Regulation EU2016/679, among which the right to request the access to personal data and the rectification and erasure of them, or the restricted use or the objection to use them.

 

vii) However, with reference to the processing of personal data with the aims declared at the previous lett. [b], the Client always has the right to erase the consensus given for this aim, in particular the erasure of the contact from the mailing list in which the Client was inserted in after his/her consensus.

 

viii) The Client has the right to lodge a complaint to the Supervisory Authority in charge, Guarantor of the protection of personal data.

 

ix) The disclosure of personal data by the Client is a contract commitment, given that it is necessary to buy the Company’s products online. In fault, this possibility will not be given to the Client so he/she can not buy following the declared procedures declared on the website of the Company. With reference, instead, to marketing activities (see to lett. [b]) done by the Company, the refusal will not permit the sending of advertising and informative material just above highlighted.

 

x) the data will not be transferred outside the European Union

REPORT FOR CLIENTS/CONSUMERS and THE OPTIONAL CONSENSUS FOR MARKETING ACTIVITIES

The model of the reporting below concerns the relationship between the Company and the final Client/Consumer. The main aim of this is not only to inform, following art.13 of the Regulation EU2016/679, the data subjects for the processing of their personal data for the simple use of them for the fulfillment of the contract (as instead the summary model of the report does below), but also with reference to marketing activity that the Company could do with them. In this case, following also the elements written above about marketing activities, it is necessary for the Company to acquire the consensus of the data subject related to a specific processing of the personal data, guaranteeing them the right of erasure of the data given before, whenever they want.

 

Report for Clients/Customers for the optional consensus for marketing activities managed by the Company

 

Following the Regulation EU2016/679 about the processing of personal data, with particular reference to the art.13, with this document Malvi & Co. Srl provides the following information to the Client:

 

i) Controller of the collection and the processing of personal data is the Company Malvi & Co. ii) The processing of personal data will be done to realise the buying process consequent to Client’s order, beyond the fact that the Company should be able to do all the accounting, commercial, and fiscal activities due to the order. Moreover, prior the free and independent consensus of the Client, the Company will use personal data to make clear to him/her, through the sending of advertising and informative material through periodic e-mails, information about products and services of the Company and eventual further activities, commercial or not, managed by the Company (1).

 

iii) The Company will process the data following the Privacy policy without disclosing them to not authorised people, neither using them for different purposes from the ones declared nor collecting nor communicating them to third parties that are not included in the following. Personal data can be disclosed only to the delegated subjects who must realize contract duties hired by the Provider and the Client (e.g. banks, door-to-door couriers, freight forwarders and accounting firms). Moreover, other Companies can know about personal data: the involved personnel in the selling process, in deliveries and the staff in charge of marketing activities, if the Client gave the consensus.

 

iv) The Company informs that it does not to proceed with neither profiling of its Clients, nor taking automated individual decision-making processes focused on this goal.

 

v) The acquired data will be preserved for a period of time not greater than the one necessary for the reasons why they were collected and later used in respect of law terms. In case of data used for marketing activities, the Client always has the right to erase the consensus given for this aim and to object the use of them in particular, following the erasure of the contact from the mailing list in which the Client was inserted in.

 

vi) The Client has the rights of artt.15 and following of the Regulation EU2016/679, among which the right to request the access to personal data and the rectification and erasure of them, or the restricted use of processing or the objection to use them. The Client has the right to lodge a complaint to the Supervisory Authority in charge, Guarantor of the protection of personal data.

 

vii) The disclosure of personal data done by the Client is a contract commitment, given that it is necessary to buy the Company’s products. With reference, instead, to marketing activities done by the Company, the missing data or the refusal of communicating them will not permit the sending of advertising and informative material just above highlighted.

 

viii) the data will not be transferred outside the European Union

Summary report for Clients/Customers

Following the Regulation EU2016/679 about the processing of personal data, with particular reference to art.13, Malvi & Co. Srl with its headquarters in Belluno (BL), via Cavessago, 44, enrolled to the Registro delle imprese (Business register) of Milan (MI), social security number 05199130963, VAT number n. 05199130963, to which the Client can send to its headquarters a specific request addressed to Malvi & Co. Srl via Cavessago, 44 32100 Belluno (BL), or, by e-mail, to the following address info@malvi.net, in charge of Controller for the collecting and processing of personal data, informs you that the processing of personal data will be done to manage your order, beyond the fulfillment of the accounting, commercial and fiscal operations due to your order.

 

The Company will process the data following the Privacy Policy without disclosing them to not authorised people, nor to use them for different purposes from the ones declared, not to transmit them to third parties that are not listed below. Personal data will be communicated only to delegated subjects to fulfill contract duties (e.g. banks, accounting firms, door-to-door courier and freight forwarders).

 

The acquired data will be preserved for a period of time not greater that the one necessary for the reasons why they were collected and later used in respect of law terms.

 

We would like to remember you that you benefit from the rights of artt. 15 and the following of the Regulation EU2016/679 among which the right to request the access to personal data and the rectification and erasure of them, or the restricted use or the objection to process them. The communication of personal data by the Client is a contract commitment, given that it is necessary to buy the Company’s products online.
